Watch and Win Terms and Conditions of Entry

The Hot Spring® Spas New Zealand Limited (NZCN 108700) Watch & Win Spa giveaway (Giveaway) is exclusively in partnership with Black Clash (together, the Promotor).    

Any information on how to enter the Giveaway forms part of these terms and conditions of entry (Terms and Conditions). Entry into this Giveaway is deemed acceptance of the Terms and Conditions.    

 Who can enter    

Entry is open to all permanent residents of New Zealand who have fulfilled the requirements set out in the Terms and Conditions.    

Participants must be over the age of 18 at the time of entry. Employees of the Promotor, its affiliates, subsidiaries, advertising, and promotion agencies, as well as their immediate family members or household members, are not eligible to participate in the Giveaway.    

How to enter    

The Giveaway will run from [18/01/24 5:00 PM to 19/01/24 5:00 PM]. Entries received after this closing time will be ineligible for participation.    

To enter, participants must watch or attend the Black Clash event on 18/01/24 (Event). A secret code word ‘BOSS’ will be announced during the Event, both through the broadcast and in person by the Promotor’s representatives at the Event. The prize advertised on the broadcast and mentioned at the Event is the same under this Giveaway.   

Upon hearing the Code Word, participants must visit hotspring.co.nz and complete the official entry form, providing their full name, email address, mobile number, and the Code Word. Participants must only enter their own name and participants with multiple entries may have all entries invalidated. Incomprehensible and incomplete entries may be deemed invalid.    

Draw   

The prize includes a Hot Spring® Hot Spot® Propel model (RRP $17,590) along with accessories Cover Cradle (RRP $995), Freshwater™ Ozone Sanitation System (RRP $995) and Polymer Steps (RRP $595) (Prize). The total value of the Prize is NZD RRP $20,175 (including GST) as at 10/12/24.    

One (1) winner for the Prize will be selected at random by the Promotor on 27/01/25 11:00 AM from all eligible entries. The Promotor will ensure that all eligible entries have an equal chance of winning the Prize. The winner will be notified via the contact information provided on the entry form within three (3) business days of the draw. The selected winner must respond within three (3) days of notification.    

Failure to respond or meet the eligibility criteria will result in disqualification of entry. The Promotor may conduct a further draw on 2/02/25 11:00 AM and an alternative winner will be chosen following the same selection process as described above.    

Delivery of the Prize is supplied by Hot Spring® to a 50km distance from any Hot Spring® retailer or dealership. Any distance beyond 50km from one of these locations will be charged to the winner at the standard delivery rate nominated by the Promotor (acting reasonably) (Delivery Payment). By agreeing to the Terms and Conditions the winner agrees that the Delivery Payment may be requested by the Promotor subject to the delivery criteria above.   

Further Terms and Conditions   

The Promoter reserves the right to request the winner to sign a winner’s deed of release (and indemnification) or any other relevant forms or agreements that the Promoter deems necessary. The Promoter may request the winner to provide proof of identity, age, permanent residency at the nominated Prize delivery address and/or entry validity in order to claim the Prize. Providing proof for verification is at the discretion of the Promoter (acting reasonably). In the event that a winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered.   

The Promoter reserves the right to conduct a redraw in the event that a participant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.   

The Prize is not redeemable for cash or transferable. No other family members, friends, office associates or any other person will be able to participate on the winner’s behalf. In the event that the Prize specified in the Giveaway becomes unavailable for any reason the Promoter may substitute a prize of like or equal value.   

Privacy Collection Statement   

By submitting an entry into this Giveaway, the participant consents to receive promotional and other marketing messages from the Promoter (including messages sent electronically for an unlimited period of time). Participants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter or by sending a reply to [email protected] stating the request.   

The Promoter and its related entities collect participants’ personal information for the purpose of conducting and promoting this Giveaway (including but not limited to determining and notifying the winner). The Promoter may also disclose personal information collected to New Zealand regulatory authorities, such as the regulators of trade promotions. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available at https://hotspring.co.nz/cookie-policy/. You may request access to or update your personal information or lodge a complaint by writing to [email protected].   

Copyright, Statutory Guarantees, Waiver and Liability   

In participating in the Giveaway, the winner agrees to participate and co-operate as required in all activities relating to the Giveaway, including but not limited to being interviewed, videoed, and photographed. The winner agrees to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winner will not be entitled to any fee for such use.   

The Promoter reserves the right to amend, cancel or suspend this Giveaway if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this Giveaway. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this Giveaway. In particular, computer generated entries and the use “scripting” is not permitted and will not be accepted.   

Any cost associated with accessing the promotional website is the participant’s responsibility and is dependent on the internet service provider used.   

Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993, as well as any other consumer protections under the Fair Trading Act 1986 or any other similar consumer protection laws in New Zealand (Non-Excludable Guarantees).   

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner; or (f) use of a Prize.   

The Giveaway and these Terms and Conditions are governed by the laws of New Zealand.
