Better Together Promotion — Terms & Conditions

The Offer and who is involved.

The "Better Together" offer (Offer) is made available by Hot Spring Spas New Zealand Limited (NZCN 108700) (Hot Spring Spas). The Offer is promoted nationally, but participation is a matter for each authorised Hot Spring Spas and Endless Pools dealer. Not all dealers take part. A dealer that has elected to take part is a Participating Dealer. Hot Spring Spas does not publish a list of Participating Dealers. Customers should confirm with their local dealer that the dealer is participating in the Offer before placing an order. Each spa is sold to the customer by the Participating Dealer, and the contract of sale is between the customer and that dealer on that dealer’s own terms of sale. Hot Spring Spas is not a party to the contract of sale. Each dealer independently sets its own retail prices and independently decides whether to take part in the Offer. All enquiries about an order, deposit, delivery or installation should be directed to the Participating Dealer.

Acceptance.

By placing a qualifying order under the Offer, you accept these terms and conditions (Terms). Any Offer advertising, point-of-sale material or dealer communication forms part of these Terms. Where there is any inconsistency, these Terms prevail.

Offer Period.

The Offer commences at 9.00am (NZST) on Friday 18 September 2026 and continues until Hot Spring Spas closes it (Offer Period). Hot Spring Spas will publish the closing date at [URL] and the Offer will not close earlier than seven (7) days after that notice is published. The Offer may close earlier, without notice, in respect of any model or bonus item that becomes unavailable, and may be withdrawn or varied at any time where required by law or by circumstances beyond reasonable control. Orders placed and confirmed in accordance with clause 5 before the Offer closes will be honoured.

Dealer participation.

Participation is determined separately for each promotion. A dealer that took part in a previous promotion is not for that reason a Participating Dealer in this Offer. A Participating Dealer may withdraw from the Offer at any time. Withdrawal does not affect any order already placed and confirmed with that dealer before the date of withdrawal, which will be completed by that dealer on the terms that applied when the order was confirmed. Customers should confirm participation with their local dealer before placing an order.

Qualifying purchase.

To qualify, a customer must, within the Offer Period, place a new order for an eligible new spa or swim spa (Eligible Product) with a Participating Dealer, pay the deposit required by that Participating Dealer and have the order confirmed in writing by that dealer. The Offer applies to new orders only. It does not apply to an order placed before 18 September 2026, to an order cancelled and re-placed, or to any purchase of ex-display, clearance, previously owned, refurbished, private label or Islander spa products.

The bonus — spas.

Each Eligible Product carries a fixed bonus package determined by its collection, as follows.

(a) Highlife Collection: FreshWater Precision Dosing System, FreshWater Smart Monitoring System, HotSpring Connected Spa App, Highlife Spa Steps, Cover Cradle and Wireless Music System with subwoofer. Total value $7,865.

(b) Limelight Collection: FreshWater Salt System, FreshWater Smart Monitoring System, FreshWater Precision Dosing System, HotSpring Connected Spa App, Limelight Everwood Steps and Cover Cradle. Total value $5,470.

(c) Hot Spot Collection: FreshWater Salt System, HotSpring Connected Spa App, Hot Spot Everwood Steps and Cover Cradle. Total value $3,980.

(d) Freeflow Collection, excluding the Freeflow Mini: FreshWater Ozone Sanitation System, Cover Cradle Valet RX and Freeflow Steps. Total value $2,585.

Highlife Collection spas include the FreshWater Salt System as standard, and it is not listed as a bonus item for that collection for that reason. Bonus items cannot be exchanged, substituted, split, carried across collections or applied to a different product.

The bonus — Endless Pools swim spas.

Bonus packages for swim spas are determined by model range, as follows.

(a) Dual-zone models, being the E2000 and the X2000: 4-Tier Swim Signature Steps, two Cover Cradles and FreshWater Ozone Sanitation System for both zones. Total value $7,475.

(b) All other Endless Pools models, including the RecSport Range, E-Series and X-Series: 4-Tier Swim Signature Steps, two Cover Cradles and FreshWater Ozone Sanitation System. Total value $5,680.

Bonus items cannot be exchanged, substituted, split, carried across ranges or applied to a different product.

Stated values are the recommended retail prices of the bonus items as at 18 September 2026, in New Zealand dollars and inclusive of GST, and represent the total recommended retail value of the bonus package for that collection or model range. The stated value describes the bonus items included at no additional cost. It is not a discount on, and does not reduce, the price payable for the Eligible Product. Bonus items have no cash value, cannot be redeemed for cash, credit or any alternative product, and cannot be traded, transferred or on-sold as part of this Offer.

One offer per purchase.

The Offer is a bonus package provided in place of, and not in addition to, any other offer, promotion, discount, voucher, gift card, rebate, group buying arrangement, advertised special, price match or other price concession applied to the same purchase. Where any other offer, discount or price concession is applied to the purchase of the Eligible Product, the Offer does not apply and the bonus package is not available. Where a customer is eligible for more than one offer, the customer must elect which one applies. The Offer may be taken with finance arranged through the Participating Dealer on the finance provider’s usual commercial terms. Where a promotional finance offer is available, such as an interest-free or deferred payment offer, the customer must elect either that promotional finance offer or the Offer, and the two cannot be combined.

Quotes issued before the Offer Period.

Quotes issued before 18 September 2026 were issued on terms that did not include the Offer. The Offer cannot be added to, or applied retrospectively to, a quote issued or an order confirmed before the Offer Period. A customer holding an earlier quote may ask the Participating Dealer to re-quote under the Offer. Any re-quote is at the Participating Dealer’s discretion and is made on that dealer’s current terms and prices.

What is not included.

The Offer covers the supply and, where applicable, fitment of the listed bonus items only. It does not include, and the customer remains responsible for:

(a) dealer delivery charges, freight, and any surcharge for rural, remote, island or difficult-access delivery;

(b) crane, hiab, spider crane, tilt-tray or specialist lifting equipment, traffic management and any associated permits or road closures;

(c) site preparation, including concrete pads, decking, foundations, fencing, drainage, excavation and landscaping, and any making good afterwards;

(d) all electrical work, including supply, installation, upgrade and certification by a licensed electrician, and any switchboard or supply upgrade;

(e) plumbing, water supply and filling costs;

(f) any building consent, resource consent, engineering assessment, council fee or compliance work, including any pool or spa fencing or barrier requirement under the Building Act 2004 and associated regulations;

(g) chemicals, consumables, water care products, replacement filters or cartridges beyond anything expressly listed as a bonus item;

(h) removal or disposal of any existing spa, packaging or site waste; and

(i) any other cost not expressly listed in clauses 6 and 7.

Delivery, fitment and availability.

Bonus items are supplied with the Eligible Product and, where the item requires fitment, are fitted at the time of delivery and installation. Bonus items cannot be supplied separately, in advance, or retrospectively after delivery has been completed. All Eligible Products and bonus items are subject to availability. Where a bonus item is unavailable, Hot Spring Spas or the Participating Dealer may substitute an item of equal or greater value or, where no equivalent is available, withdraw that item from the bonus package and notify the customer before the order is completed. Delivery timeframes are indicative only and are estimated by the Participating Dealer. To remain eligible, an order placed during the Offer Period must be taken to delivery within six (6) months of the order date, unless a longer period is agreed in writing by the Participating Dealer.

Cancellation and change of order.

If a qualifying order is cancelled by the customer, the bonus package is forfeited in full. If a customer changes the ordered model after the order is confirmed, the bonus package applying to the new model at the date of the change applies, and no top-up, credit or refund is payable in respect of any difference in value. Where an order is cancelled after bonus items have been supplied or fitted, the customer must return those items in the condition supplied or pay the recommended retail price for them.

Consumer rights.

Nothing in these Terms limits, excludes or modifies, or purports to limit, exclude or modify, the statutory consumer guarantees provided under the Consumer Guarantees Act 1993, or any other consumer protection under the Fair Trading Act 1986 or any other similar consumer protection law in New Zealand (Non-Excludable Guarantees). Bonus items carry the same manufacturer’s warranty and consumer guarantees as they would if purchased separately. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Hot Spring Spas (including its officers, employees, agents and Participating Dealers) excludes all liability for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Offer, the supply, fitment or use of any bonus item, any delay in delivery or installation, or any variation in the value of a bonus item to the value stated in these Terms.

Errors and variation.

Hot Spring Spas reserves the right to correct any pricing, value, specification or typographical error in any Offer material at any time, and may amend these Terms where required by law or where necessary to preserve the proper operation of the Offer. Any amendment will be published at [URL] and will not affect orders already placed and confirmed.

Privacy.

Personal information collected in connection with the Offer will be collected and held by Hot Spring Spas and the relevant Participating Dealer for the purposes of processing and fulfilling the order and administering the Offer, and will otherwise be handled in accordance with the Hot Spring Spas Privacy Policy available at [URL] and the Privacy Act 2020.

General.

The Offer is available to New Zealand residents aged 18 years or over purchasing for domestic use. It is not available for commercial, hire, rental, resale or export purchase without the prior written approval of Hot Spring Spas. There is no limit on the number of qualifying purchases a customer or household may make under the Offer. These Terms are governed by the laws of New Zealand and the parties submit to the exclusive jurisdiction of the New Zealand courts.
